Subject-Matter Jurisdiction
Subject-Matter Jurisdiction, Diversity, and Removal
Subject matter jurisdiction a court’s legal power or authority to hear a particular type of dispute. It is important to recall at the outset that federal court jurisdiction is limited both by the U.S. Constitution and by statute. Article III of the U.S. Constitution establishes the types of “Cases” and “Controversies” to which the federal “judicial Power shall extend.”
This section discusses diversity jurisdiction and removal issues.
